Terms of Service
1. Provider and scope
Provider: Conscious Innovation Lab OÜ, Tööstuse tn 48, 10416 Tallinn, Estonia, registration number 14825448 (Estonian Business Register), VAT ID EE102459135 (“Fotoklar”, “we”). These terms govern all consumer orders via fotoklar.com.
2. Service
Fotoklar uses artificial intelligence to create a digital photo series in multiple styles from your uploaded photos (8–15 selfies). Scope depends on the chosen package. All delivered images are AI-generated, not photographs. Delivery is digital via a private gallery link by email, usually within ~2 hours of completed upload; this is an estimate, not a guaranteed deadline.
3. Contract and prices
The contract is concluded upon completion of checkout (Stripe). Prices shown at order time apply. One-time payment, no subscription.
4. Your uploads
You warrant that (a) the uploaded photos show you, or you hold the explicit consent of the person shown, (b) you hold the necessary rights to the photos and (c) no third-party rights are infringed. Result quality depends significantly on the quality and variety of your uploads.
5. License to results
Upon full payment you receive a perpetual, worldwide, non-exclusive license to use the delivered images for private and professional purposes. Prohibited: use to deceive authorities about identity (e.g. ID documents) and any unlawful use.
6. Right of withdrawal
See the withdrawal policy. You have the statutory 14-day right of withdrawal.
7. Availability, retention
Results remain downloadable for 30 days after delivery, then deleted; uploads are deleted 7 days after delivery. Please download in time.
8. Liability
Unlimited liability for intent and gross negligence and under product liability law. For slight negligence, liability only for breach of essential contractual duties, limited to foreseeable, contract-typical damage.
9. Final provisions
Estonian law applies, excluding the UN Sales Convention; mandatory consumer protections of your country of residence remain unaffected.
